Brownfield Redevelopment
Gilberti Stinziano Heintz & Smith, P.C. represents private developers,
municipalities and public authorities participating in or seeking acceptance
into the New York State Brownfields Cleanup Program (BCP) and provides
advice on the availability of federal and state government funding for
Brownfields redevelopment, including tax credits under the Brownfields
Tax Credit Program.
Our attorneys have extensive experience with contaminated site remediation
and redevelopment under federal and state Superfund legislation and the
State Department of Environmental Conservation's (DEC) new Brownfields
Cleanup Program.
We closely follow the ongoing development of regulations under this
program and the prospects for any statutory revisions. We also understand
the importance of community involvement in cleanup and redevelopment
decisions.
Gilberti Stinziano Heintz & Smith, P.C. serves as environmental
counsel for site cleanups under the New York State Voluntary Cleanup
and Brownfields Cleanup Program, including petroleum and solvent contaminated
former industrial sites located in mixed residential/commercial neighborhoods.
We have also successfully negotiated assignable town and village tax
trust agreements resulting in multi-million dollar reductions in past
and future property taxes; and negotiated resolutions to, or dismissals
of, multiple federal and state legal actions involving the State of New
York and local municipalities.
