Gilberti Stinziano Heintz & Smith, P.C. has one of the largest environmental
and land use practices in New York State and across
the Northeast, which includes service to regulated
industries and government entities. We provide environmental counsel
to more than 85% of New York's stone, sand, gravel, cement, concrete
and blacktop producers. We represent approximately 12% of the electric
power generating capacity in New York State, and we provide advice to
one of the nation's largest retail developers. We have experience in
the development of industrial properties, including large and small power
plants, manufacturing facilities, tank farms, quarries and mines, as
well as representation of industrial development agencies and public
entities.
Our attorneys have supervised the environmental review for, permitted and defended in litigation dozens of publicly unpopular projects, including major landfills, power plants, mineral mines, industrial plants, and regional shopping malls across New York State and throughout the Northeast. The firm regularly practices in environmentally sensitive areas such as the Adirondack Park region, the Southern Tier, and along the Hudson River corridor, and has successfully aided in clean up and development of some of the most highly contaminated land in the country. Our attorneys have extensive experience in those topics typically important to the development of industrial, commercial and retail projects. These include real estate acquisitions, leases, easements and rights-of-way; municipal land use control and the creation of special purpose municipal districts; contaminated site remediation and brownfield development; the regulation of air pollution, waste water and other aspects of project construction and operation such as erosion, noise and visual impacts that are typically addressed in the state and federal environmental review process.
