Mining For more than twenty-five years, the core of our environmental practice has been the construction aggregates industry. We provide environmental counsel to more than 85% of New York's stone, sand, gravel, cement, concrete and aggregate producers. Gilberti Stinziano Heintz & Smith, P.C. has expertise in the acquisition and development of industrial properties, including quarries and mines and regularly represents clients in the mining and commercial aggregate industries, developing strategies for siting and permitting mining operations, commercial aggregate and asphalt and ready mix concrete facilities. In addition, we represent landowners to protect their rights to minerals, including oil and gas, which may be found beneath the surface of their land. By applying our knowledge of state and federal permitting regulations, land use and zoning laws, town and municipal law and operation siting standards, we can handle all land lease negotiations and monitor terms enforcement. Our experience in real property valuation allows us to develop the most equitable solution for our clients when disputes arise. Gilberti Stinziano Heintz & Smith, P.C. has extensive experience working with the State's Mined Land Reclamation Law, the New York State Department of Environmental Conservation's Division of Mineral Resources, and local municipalities in acquiring the required State and local permits and approvals for numerous mining clients. We have had significant success in securing the existing rights of our clients to access the entirety of their aggregate reserves, including securing clients' "grandfather" exemption from the State Environmental Quality Review Act, while ensuring that mining operations meet and exceed all applicable state, federal and industry standards and regulations.
