Permitting/Right-to-Build

At Gilberti Stinziano Heintz & Smith, P.C., our attorneys have supervised the environmental review and permitting processes for dozens of major projects, including landfills, power plants, mineral mines, industrial plants, commercial office developments, regional shopping malls, and mixed-use developments across New York State.

The services we provide to our clients requiring permitting include: evaluating options to meet legal requirements under Town Law, Municipal Law, SEQRA, NEPA and Environmental Conservation Law; coordinating with town attorneys to assure all legal requirements are satisfied for the various town actions required to authorize the project.; supervising expert preparation of materials for presentation to town and state boards and agencies and at public hearings; directing the scoping and preparation of SEQRA documents including the DEIS, FEIS and responses to public comments; and appearing at hearings before town and county agencies and boards and before DEC and other state regulatory agencies.

We are experienced in assessing land owner rights, vested rights and establishing authorizations under land use controls.
